የፍርድ ቤት-መር የአለመግባባት መፍቻ ሥርዓቶችን መዘርጋት

በየትኛውም ጊዜ፣ አካባቢ እና ኅብረተሰብ እንደሚኖረው ሁሉ በአማራ ክልልም ሰዎች እና ቡድኖች በግላዊ፣ ቤተሰባዊ፣ ማኅበራዊ፣ ኢኮኖሚያዊ እና ፖለቲካዊ እንቅስቃሴ ሲደርጉ አንዱ ከሌላው ጋር በሚያደረጋቸው መስተጋብሮችና ግንኙነቶች አለመግባባቶች እና ግጭቶች ሊፈጠሩ ይችላሉ፡፡ የክልሉ ኅብረተሰብም አለመግባባቶች እና ግጭቶች እንዳይከሰቱ የሚከላከልበት፣ የተፈጠሩ አለመግባባቶችን ለመቆጣጠር ወይም ባሉበት ለመያዝ እና ለመፍታት የሚችልባቸው ልዩ ልዩ ባሕላዊ እና ዘመናዊ ሥርዓቶች አሉት፡፡ የክልሉ ፍርድ ቤቶችም ኅብረተሰቡ የተሟላ ፍትሕ እንዲያገኝ ዘመናዊ ፍርድ ቤቶች ከሚሰጡት መደበኛና የዘወትር የፍትሕ አገልግሎት በተጨማሪ በክልሉ ያሉ ልዩ ልዩ የባሕል ፍርድ ቤቶችን እና ሌሎች አማራጭ የአለመግባባት መፍቻ ዘዴዎችን በመደገፍና በማጠናከር ላይ ይገኛሉ፡፡ በዚህ ረገድ የክልሉ ጠቅላይ ፍርድ ቤት ከባሕል ፍርድ ቤቶች ጋር በተያያዘ እየተገበራቸው ካሉ በርካታ ተግባራት ሌላ እንደ ማግባባት/መደራደር (Negotiation)፣ አስማሚነት (Mediation)፣ ማስታረቅ (Conciliation) እና የግልግል ዳኝነት (Arbitration) የመሳሰሉ ዘመናዊ አማራጭ የአለመግባባት መፍቻ መንገዶችን ከፍርድ ቤቶች ጋር በማስተሳሰር ፍርድ ቤት-መር የአለመግባባት መፍቻ ሥርዓቶች (Court-connected or court-annexed ADR) እንዲዘረጉና የተቀናጀ የፍትሕ አሰጣጥ እንዲዳብር እየተጋ ይገኛል፡፡ በዚህም መሠረት ከፍርድ ቤት-መር የአለመግባባት መፍቻ ሥርዓቶች (Court-connected or court-annexed ADR) መካከል የፍርድ ቤት-መር አስማሚነት (Court-connected or court-annexed mediation) የሚመለከት መመሪያ አውጥቶ በተወሰኑ የተመረጡ የክልሉ ፍርድ ቤቶች የሙከራ ትግበራ ሲያደርግ ቆይቷል፡፡ በአሁኑ ወቅትም ይህን ወደ ሙሉ ትግበራ ለማስገባት በመሥራት ላይ ይገኛል:: የአስማሚነት አንድ አካል እንደመሆኑ መጠን ፍርድ ቤት-መር አስማሚነት በፍትሕ አስተዳደር በተለይም በፍትሐ ብሔር ፍትሕ አስተዳደር አለመግባባቶችንና ክርክሮችን በአጭር ጊዜ፣ ያለብዙ ውጣ ውረድ፣ እንግልትና ወጭ፣ በራስ ባለቤትነትና ወሳኝነት አነታራኪ ጉዳዮችንና ከዚሁ ጋር የሚገናኙ ነገሮችን በሰላም በመነጋገር፣ አንዱ የሌላኛውን ወገን ፍላጎት፣ ጥቅም፣ መብት፣ ሁኔታ፣ አረዳድ፣ አተያይና የመሳሰሉ ጉዳዮች በመረዳትና በማወቅ፣ ለክርክር ቁልፍ በሆኑ ጉዳዮች ላይ ትኩረት በማድረግ በገለልተኛ

አስማሚ አሳላጭነትና ከአድሎና ወገንተኝነት የራቀ ድጋፍ አማካይነት ስምምነት ላይ ለመድረስ የሚያስችል ዘዴ ነው፡፡ በግል መጠበቅ የሚገባቸውን ምሥጥሮች ይዞ በማስቀረት፣ በክርክር ሂደት ሊከሰቱ የሚችሉ ተጓዳኝ የአእምሮና የሞራል ጉዳቶች በማስቀረት ሰላማዊና ዘላቂ መፍትሔን ለማምጣት እድል የሚከፍት ነው፡፡ የሚፈርስ ቤተሰብን የሚታደግ፣ በክርክር ሂደት በረጅም የክረክርና የማስረጃ አቀራረብ፣ በጊዚያዊ እግድ፣ በልዩ ልዩ ሕጋዊ የሆኑና በሰበብ-አስባብ ሊቀርቡና ሌላኛውን ወገን ለብስጭት፣ ለልዩ ልዩ ጉዳቶች በማጋለጥ የተበዳይነት ስሜትንና በቀል ማርገዝን የሚያስቀር ጤነኛ የሆነ ጉርብትናን፣ ማኅበራዊና ኢኮኖሚያዊ ግንኙነትን ለማስቀጠል የሚያስችል፣ የፍርድ ቤት የጉዳይ ክምችትን ከመቀነስና ክርክርን በወቅቱ ከመቋጨት ያለፈ ዘርፈ-ብዙ ጠቀሜታዎች ያሉት የአለመግባባት መፍቻ መንገድ ነው፡፡

Coordination Office of forum for the judicial cooperation

The role of the judiciary and justice institutions in the Amhara region is very important in ensuring the rule of law, ensuring justice and ensuring peace, and accelerating social and economic development. These judicial and justice institutions, namely the Court; Justice Bureau; Police Commission and the Prison Commission, are expected to work together on issues related to common goals, while maintaining the functions and responsibilities assigned to them in their respective establishment laws. Since the justice system, especially the criminal justice administration process, passes through these institutions and the work of one institution can serve as a starting point for another, it is necessary for them to work in a coordinated manner. As a result, forum for judicial cooperation was newly established in September 2017 and the Coordination Office was organized under the Supreme Court. The member institutions of the cooperation forum identified the areas in which they would work together and set their operating procedures, and signed an implementation charter. In addition, among the proclamations approved by the regional government in its regular meeting in February 2017, the regional Supreme Court was authorized to organize and coordinate the judicial and justice cooperation forum under Proclamation No. 297/2017, under Article 5, and since the works that can be done in cooperation and coordination were also listed under Article 10. In this regard, the cooperation work is being expanded to the woreda level as well.

Office of the Advisory Council of the customary Courts

Under Article 5(8) of the “Amhara Regional Courts Strengthening Proclamation No. 297/2017”, the Amhara Regional Supreme Court has been authorized to recognize, organize and strengthen the customary courts and to carry out this task under the supervision of the Amhara Region Supreme Court, and therefore, the “Amhara Region customary Courts Establishment and Recognition Proclamation No. 298/2017” and the “Amhara Region customary Courts Implementation Directive No. 23/2018” have been issued and put into effect. In accordance with the Proclamation to establish and recognize the Amhara Region customary Courts and the Directive to Implement the Proclamation, the Amhara Region customary Courts Advisory Council, headed by the President of the Supreme Court of the Region, and the Advisory Council Office organized under the Supreme Court have been established. The Office of the Advisory Council of customary Courts also identifies and coordinates trainings on traditional courts; coordinates and directs media activities related to customary courts; monitors, supports and supervises the activities of the Zone and Woreda Advisory Councils; organizes and implements the issues discussed and decisions made by the Advisory Council; receives and organizes the performance reports of customary courts, and sends them to the Regional Council as part of the Supreme Court report; works with relevant parties, especially with member institutions of the Advisory Council, to find solutions to problems encountered in the implementation of the proclamation issued to establish and recognize customary courts; collects and manages in-kind and financial support to strengthen the customary courts.

These services aim to reduce barriers to access and ensure that all parties—especially those from vulnerable or marginalized groups—have the resources they need to effectively participate in the judicial process.
