A presentation on \u201cThe Role of Courts in Investment Matters\u201d was delivered to judges participating in the Second Annual Conference of Amhara Region Courts, which is being held under the theme \u201cEnhancing Access and to Excellence in Judicial Service.\u201d<\/p>\n\n\n\n

The presentation was delivered by Associate Professor Zakarias Kenea, who provided an extensive overview of the nature and characteristics of investment, investment-related disputes, national and international investment laws, and the role of courts in resolving investment disputes.<\/p>\n\n\n\n

Associate Professor Zakarias explained that investment matters involve various parties and institutions, and that disputes arising among investors, government bodies, and other stakeholders require specialized legal knowledge and careful judicial consideration.<\/p>\n\n\n\n

He noted that disputes involving foreign investors require consideration not only of domestic laws but also of international agreements to which Ethiopia is a party and principles of international investment law.<\/p>\n\n\n\n

In this regard, the presentation highlighted the role of multilateral and bilateral investment agreements, as well as the international institutions and agreements to which Ethiopia is a party, in the resolution of investment disputes.<\/p>\n\n\n\n

From this perspective, the presentation emphasized that the role of courts begins with having a comprehensive understanding of laws governing investment and relevant international agreements.<\/p>\n\n\n\n

It was explained that judges\u2019 adequate understanding of investment laws, arbitration procedures, and related international legal frameworks is essential for adjudicating investment-related cases based on applicable law and evidence.<\/p>\n\n\n\n

Although priority is generally given to resolving investment disputes through negotiation and dialogue, Associate Professor Zakarias noted that the role of courts does not end when a dispute proceeds to arbitration.<\/p>\n\n\n\n

In particular, courts play important roles by issuing interim measures, assisting in the constitution of arbitral tribunals, facilitating the collection of necessary evidence, recognizing and enforcing arbitral awards, and conducting judicial review within the limits permitted by law.<\/p>\n\n\n\n

The presentation further emphasized that the significant role of courts in arbitration and their support are fundamental to ensuring that arbitration proceedings are effective and that arbitral decisions are enforceable. However, such judicial support should not replace the arbitration process and must remain within the limits prescribed by law.<\/p>\n\n\n\n

It was also noted that the existence of a legal system through which foreign investors can enforce their rights and interests before courts is crucial to creating a favorable investment environment. In this regard, courts have an important institutional role in ensuring the rule of law, the enforceability of decisions, and the legal protection of investors within the investment environment.<\/p>\n\n\n\n

The presentation also addressed Ethiopia\u2019s participation in international investment law frameworks, particularly its engagement in multilateral investment agreements and institutions, as well as its participation in the African Continental Free Trade Area (AfCFTA). It was explained that these legal frameworks require judges to have specialized knowledge when dealing with investment-related matters.<\/p>\n\n\n\n

In conclusion, as investment becomes increasingly interconnected and commercial relationships increasingly cross national borders, courts and judges need to have a sound understanding not only of domestic investment laws but also of international investment law, arbitration, and mechanisms for the enforcement of decisions, and should be adequately prepared to handle emerging investment-related disputes.<\/p>\n\n\n\n

The presentation forms part of the ongoing institutional efforts to strengthen the knowledge and skills of judges in various areas of law, enabling them to develop the knowledge and competence required to effectively handle modern and increasingly complex legal matters.<\/p>\n\n\n\n
