(Amhara Region Supreme Court)

A training session on the role of courts in safeguarding the right of women, children and persons with disabilities to access justice was provided to judges on the third day of the Second Annual Conference of Amhara Region Courts Judges.

The conference, being held under the theme “Expanding Access and excellence in judicial service,” focused on the responsibilities of courts in ensuring that vulnerable and disadvantaged groups can effectively exercise their right to justice.

The training was delivered by Ms. Gojam Abebe, Women’s Rights Expert at the Ethiopian Human Rights Commission, and Mr. Arega Shiferaw, Disability Rights Expert at the Commission.

The trainers explained that the right of women, children and persons with disabilities to access justice encompasses non-discriminatory access to justice institutions; the provision of fair and equitable services without discrimination based on age, gender or disability; access to legal assistance and information; and the establishment of accessible and accommodating court proceedings and facilities.

Addressing the rights of women and children to access justice, Ms. Gojam Abebe emphasized that access to justice entails the ability to approach justice institutions without discrimination and to receive fair services regardless of age, gender or disability. It also includes access to legal assistance and information, as well as the creation of appropriate and supportive courtroom environments.

She further underscored that courts have a responsibility to uphold the rule of law and ensure respect for human rights, give priority to the best interests of the child, and impose appropriate and deterrent sentences for crimes committed against women and children.

She also explained that judicial decisions should take into consideration the Universal Declaration of Human Rights (UDHR), the Convention on the Elimination of All Forms of Discrimination Against Women (CEDAW), the Convention on the Rights of the Child (CRC), and other international human rights instruments to which Ethiopia is a party.

Speaking on the role of courts in ensuring access to justice for persons with disabilities, Mr. Arega Shiferaw noted that persons with disabilities continue to face various barriers, including attitudinal, physical, communication and institutional barriers.

He emphasized the need for courts to create disability-friendly environments, establish systems that address communication and language barriers, provide appropriate support services, including access to psychological professionals where necessary, and put in place institutional arrangements that enable persons with disabilities to access justice on an equal basis.

The training also covered legal frameworks related to the rights of persons with disabilities, including Proclamation No. 568 on the Employment of Persons with Disabilities, Building Proclamation No. 1356/2024, Federal Courts Proclamation No. 1234/2021, and other relevant laws and legal frameworks.

The provision of such training to judges is expected to contribute to ensuring that judicial services provided to women, children and persons with disabilities are fair, accessible and respectful of human rights, while also strengthening judges’ knowledge, skills and professional capacity.

The Second Annual Conference of Amhara Region Courts Judges, which commenced on Meskerem 20, 2019 E.C. under the theme “Expanding Access and excellence in judicial service” will continue tomorrow with additional training sessions on various judicial and legal topics.

<figure
